دور المجلس الدستوري الجزائري في تفسير الدستور

الملخص
أصبح تفسير أحكام الدّستور مرحلة أولية وضرورية في عملية الرقابة الدستوريّة نظرا للطابع العام والمجرّد للقواعد الدستورية مقارنة بالقواعد القانونية الأخرى، لكن هذه الخصوصية في التفسير الدستوري تطرح العديد من الإشكالات أهمها تلك التي تتعلّق بالهيئة التي تتولى تفسير الدستور والأدوات المعتمدة في ذلك. تصدى المجلس الدستوري الجزائري لتفسير الدستور في العديد من قراراته وآرائه دون وجود أي نص دستوري يخوله ذلك، لكن المجلس استند على مهامه في الرقابة الدستورية في تفسير الدستور معتمدا على العديد من أدوات التفسير كالاستنباط والاستنتاج الكلي وغيرها. English abstract: The interpretation of the Constitution has become a preliminary and necessary stage in the process of constitutional control due to the general and abstract nature of constitutional rules compared to other legal rules, but this specify of the constitutional interpretation poses many issues the most important of them is related to the authority that is interpreting the constitution and the tools adopted in this way. The Algerian Constitutional Council has delivered the interpretation of some constitutional dispositions in many of its decisions and opinions without any constitutional provision authorizing it. However, the Council relied on its function in constitutional control as a foundation to the interpretation of the constitution, using many tools of interpretation as the deductive method, and total conclusion.
