الملخص
يعتبر القطاع الفلاحي من أهم القطاعات الرئيسية بالنسبة لدول العالم – بما فيها الجزائر- نظرا لما يحققه من اكتفاء ذاتي وأمن غذائي.ولتحقيق هذا الهدف، تسعى الدول جاهدة إلى الاهتمام بالقطاع الفلاحي، والأراضي الفلاحية من أجل ضمان نموها الاقتصادي وتطورها الاجتماعي، ولا يتأتى لها ذلك إلا عن طريق الاستثمار في القطاع الفلاحي. وتعتبر عقود الامتياز الفلاحي التي تمنحها الدولة للمستثمرين أصحاب الامتياز مظهرا من مظاهر الاستثمار في القطاع الفلاحي، ونظرا لأهميتها عمدت الدولة الجزائرية إلى تنظيمها بموجب القانون رقم 10/03 المحدد لشروط وكيفيات استغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة، والذي جاء من أجل الوصول إلى استقرار العمل في مجال الاستثمار الفلاحي والحفاظ على الأملاك الوطنية. وستقتصر دراستي في هذا المقال على تحديد آثار عقد الامتياز الفلاحي بالنسبة للمستثمر صاحب الامتياز، وذلك بالتطرق إلى حقوقه والالتزامات المترتبة عليه. Abstract: The agricultural sector is among the important sectors for the world countries (Including Algeria) due to its achievements in food security and Self-sufficiency. In order to achieve this goal, Countries are interested in agricultural lands, to ensure their economic growth and social development, and this can be achieved only through investment in the agricultural sector. The concession contracts granted by the countries to concessionary investors are considered manifestations of investment in the agricultural sector, given their importance, The Algerian state regulated it under Law No. 10/03, which Specify the terms and conditions of the exploitation of private agricultural lands of State's property, this low stabilize the work in the field of agricultural investment and preserve national property. The aim of our study is to determine the agricultural concession contract effects for the concessionaire investor by addressing his rights and Duties.
