الملخص
الملخص : لقد حرص المشرع الجزائري في مختلف النصوص التشريعية والتنظيمية على إدراج مايعرف بالضوابط أو القيود البيئية في منح رخصة البناء ليحمي بداية البيئة وأيضا ليحافظ على النظام العمراني والجمالي للبنايات والمدينة والمناطق المحمية، فلا يمكن أبدا تصور تنمية دون تعمير وبناء، وهذا الأخير لابد أن يسيج بقيود بيئية توازن بين الحق في التنمية وحماية البيئة للوصول إلى تنمية مستدامة. Abstract: The Algerian legislature has in various legal and regulatory texts on the inclusion of the so-called regulations or environmental constraints in granting the construction permit to protect the environment as well as to the system constructional and aesthetic system for the city and protected buildings، can never imagine development without the reconstruction of the building of the latter must fencing environmental restrictions a balance between the right to development and the protection of the environment to reach sustainable development.
