واقع وآفاق التمثيل النيابي للمرأة في الجزائر

الملخص
في إطار الإصلاحات السياسية الشاملة في الجزائر تعززت مكانة المرأة الجزائرية في المجال السياسي عن طريق ما يسمى" بنظام الكوتا"، أو " الحصة" الذي جاء بموجب التعديل الدستوري لسنة 1996 الجزائري. وكرسه المشرع الجزائري بموجب قانون عضوي، حيث تم تخصيص مقاعد للمرأة في المجال البرلماني، بعدما كانت نسبة تواجدها في البرلمان بغرفتيه ضعيفة ومحتشمة. وهو تقدم إيجابي يحسب للمؤسس الدستوري الجزائري والمشرع على السواء، وتساير به الجزائر الكثير من الدول المتقدمة في هذا المجال بعدما كانت المشاركة السياسية في الانتخابات البرلمانية حكرا على الرجال فقط. ولكن الملاحظ على الدساتير الجزائرية السابقة، لم تحرم المرأة بصريح العبارة من حق الترشح وإنما جاءت الدساتير متسمة بالعمومية، فمن الناحية القانونية لا يوجد حرمان المرأة من المشاركة في الحياة السياسية، وما القانون العضوي إلا تحصيل حاصل لتدعيم المرأة في المجال السياسي. Within the political reforms in Algeria, the position of woman is consolidated in the political field through which we name << quota system>> or << share>> which is emerged by virtue of the Algerian constitutional modification of the year 1996. It has been ratified by the Algerian legislator by virtue of the organic law, considering that seats have been reserved to woman, in the parliamentary field with its two chambers weak and decent.This is a posit if development estimated to the firm ,the constitution and the legislator together ,Algeria has accompanied a great number of the developed countries with it in this field ,afterwards the political participation has been reserved only to men .But we observe concerning the precedent constitution that it has not expressly prohibited to woman to have the right to candidature, however which characterize the constitutions is the generality, concerning the juridical field there is no prohibition to woman in the political life. the organic law is only a tautology to support woman in the political field.
