الملخص
الملخص : نتيجة الإصلاحات الاقتصادية التي تبناها المشرع الجزائري بدأً من تخليه على المنهج الاشتراكي وإتباعه للمنهج الليبرالي وكذا التعديلات المستمرة لقوانين الاستثمار ، حاول من خلالها تكريس مبادئ حماية الاستثمار الأجنبي لتنفيذ استراتيجياته التنموية . فإلى جانب اهتمامه بمعاملة الاستثمارات سواء من الجانب الإداري أو الجانب الاقتصادي فإنه سعى أيضا إلى حمايتها من خلال وسائل قانونية وكذا تقديم ضمانات مختلفة إلى هذه الاستثمارات . و من أجل توفير مناخ مناسب للاستثمارات عمل المشرع على وضع ضمانات قصد حماية المستثمرين تهدف إلى ضمان ضد المخاطر التي من شأنها الإضرار بمصلحة المتعامل المتعاقد أو الأجنبي ، ولتفادي هذا الأضرار كرس قانون الاستثمار هذه المبادئ . Abstract : As a result of the economic reforms adopted by the Algerian legislator, he began to abandon the socialist approach and follow the liberal approach, as well as the continuous amendments to the investment laws, in which he tried to devote the principles of protecting foreign investment to the implementation of his development strategies. Apart from his interest in treating investments both from the administrative side and the economic side, he also sought to protect them through legal means as well as provide various guarantees to these investments. In order to provide a favorable environment for investments, the legislator has worked to put in place guarantees to protect investors aimed at guaranteeing against risks that would harm the interests of the contracting or foreign client.
