الضمانات القانونية لتأسيس الأحزاب السياسية في الجزائر

الملخص
تعتبر الأحزاب السياسية من أهم المؤسسات في كل الأنظمة السياسية بوصفها قناة هامة وآلية من آليات المشاركة في الحياة السياسية التي أضحت سمة من سمات العصر الحديث . ويرتبط بما سبق قيام الأحزاب بدورٍ هام في مجال التوعية وتكوين الرأي العام وتوجيهه من خلال ما تتبناه من آراء ووجهات نظر خاصة بالقضايا السياسية والاقتصادية والاجتماعية الماسة بعموم أفراد المجتمع وطرحها على الرأي العام مما يفضي إلى ربط المواطنين بقضايا مجتمعهم . ولا يقتصر دور الأحزاب السياسية على هذه الجوانب حيث تقوم بمراقبة أعمال القائمين على الحكم على نحو يحول دون انحرافهم ويقود إلى تحقيق مصلحة المجتمع السياسي فضلاً عن دورها المؤثر في العملية الانتخابية بما تقدمه من مرشحين أو بمساعدتها للناخبين على تكوين قناعاتهم الأمر الذي جعل الأحزاب من أهم أركان النظام الديمقراطي . وعلى هذا الأساس اضحت حرية تأسيس الأحزاب السياسية والانضمام إليها وممارستها لأنشطتها احدى حقوق وحريات الإنسان المسجلة في العديد من الوثائق العالمية ودساتير معظم الدول والجزائر على غرار الدول التي كرست التعددية الحزبية في دساتيرها منذ التعديل الدستوري سنة1989،حيث وضعت مجموعة من الضمانات القانونية التي تكفل حق تأسيس ونشاط الأحزاب السياسية.

On this basis, has become the freedom to establish political parties and join them and the exercise of its activities, a human rights and freedoms registered in many international documents and constitutions of most countries And Algeria, along the lines of countries that have been devoted multiparty system in their constitutions since a constitutional amendment in 1989, where he developed a set of legal safeguards that ensure the right of establishment and activity of political parties .
