الملخص
Judiciary is one of the important issues that jurists have elaborated in talking about. That because of the vital role of administration of justice in organizing and improving the community affairs. Moreover, by judiciary people keep justice, bloods, property and honors as well as development. The judiciary is one of the most important authority in the Islamic state. That the judge when rolls out justice between people, he corporated in applying Sharia and keeps in safe all rights of people as well as preventing as standing against assault and aggression of all kinds. The judiciary independence means that judges should not render, when doing their task, to a superiority of any kind, and they should only judge according to Sharia law and believe without any other consideration. The principal of independence requires the standing against any intervention of any power whatsoever it is to direct it towards a specific direction or stop its normal way or contradict its rules.
