الملخص

الملخص: لقد أتاحت الحرية المطلقة على الإنترنت سهولة إصدار أي فرد في أي مكان في العالم لأي موقع يكتب فيه ما يريد ويهاجم فيه أي شخص سواء كان فرداً أو جماعة رسمية أو غير رسمية، أو أن يصدر موقعاً يطلق عليه صحيفة أو جريدة، وينشر عليها مواد منقولة من أي مصدر أو مرسلة من أي قارئ، دون التأكد من مصدرها، ودون أي ضوابط للنشر . بل إنه في الوقت الذي انتشرت فيه المطالبة بحقوق الملكية الفكرية نجد هذه الحقوق تهدر بسهولة من خلال مواقع الإنترنت التي تقوم بالاستيلاء على مواد صفحاتها من أي موقع آخر أو من صحيفة مطبوعة لا فرق دون أية مراعاة للملكية الفكرية التي يتحدث عنها العالم، ليس هذا فقط بل إن بعض المواقع التي تعد مواقع كبرى تقوم باستلام المادة من المراسلين وتنشرها دون أي مقابل مادي، بدعوى أنه لا يوجد ميزانية للدفع مقابل المواد المنشورة، رغم أن بعض هذه المواقع مدعمة بشكل كاف، ولكنها تستغل أيضا تعطش البعض ورغبته في نشر مواد مكتوبة باسمه لا يتمكن من نشرها في صحف مطبوعة. من أجل هذا تأتى أهمية هذا البحث حول حقوق الملكية الفكرية على شبكة الإنترنت في ظل ثورة هائلة في النشر الإلكتروني على مستوى العالم حيث بدأت هذه الثورة دون أي ضوابط أو مراعاة للقوانين فخرجت عشوائية إلى حد كبير تحتاج إلى من ينظمها ويقننها، خاصة في ظل نظام دولي جديد يعتمد على التطور والسيطرة والسلطة.
