الملخص
التنزيل أوجبه المشرع في قانون الأسرة الجزائري فهو خليط بين الوصية والميراث، إذ تحل إرادة المشرع محل إرادة الموصى فيعطى الأحفاد غير الوارثين ما استحقه أصلهم من تركة جدهم أو جدتهم في حدود الثلث تقسم عليهم للذكر مثل حظ الأنثيين. ويقدم التنزيل باعتباره وصية واجبة على الوصية الاختيارية. كما أن الكيفية التي شرع بها التنزيل لا يوجد لها نظير في الوصايا الشرعية خاصة وأن المشرع قصره على الأحفاد دون غيرهم ولم يراعى في ذلك حالتهم وحالة غيرهم الذين حرمهم من هذا المقدار. Abstract: The law of the Algerian family is a mixture between the commandment and the legacy. The legislator's will replaces the will of the recommended, and the grandchildren who are not inheritors are given the inheritance of their grandfather or grandmother within a third (male gender twice the female gender).
