إفشاء السر الطبي بين التجريم والإباحة

الملخص

بمقتضى المادة 301 من قانون العقوبات الجزائري، يلتزم الطبيب بالحفاظ على سرية كل ما علمه في إطار مهنته. و يشمل السرّ ليس فقط ما باح به المريض إليه و إنما أيضا كل ما رآه الطبيب، أو سمعه، أو فهمه. غير أنّه، سواء للمصلحة العامة، أو للمصلحة الخاصة للمريض أو لذوي حقوقه، نص القانون على جملة استثناءات ترد على هذا الالتزام و التي تسمح للطبيب أن يبلغ إلى علم السلطات الإدارية و القضائية، بعض الوقائع ذات طابع طبي، و من هذه الوقائع على وجه الخصوص: الأمراض المعدية المبينة وفق قائمة خاصة، أعمال العنف البدني ضدّ القصر، وحالات الإجهاض. Under article 301 of the Algerian Penal Code, a doctor is obliged to keep confidential all that he has learned in the context of his profession. The secret includes not only what the patient has given him but also what the doctor has seen, heard or understood. However, whether for the public interest or for the private interest of the patient or his or her rights, the law provides for a number of exceptions to this obligation which allow the doctor to inform the administrative and judicial authorities of certain facts of a medical nature. : Infectious diseases listed on a special list, acts of physical violence against minors, and abortions.
