تحولات السلطة التنفيذية في نظر الاجتهاد الدستوري

الملخص
ملخص باللغة العربية: إن التعديل الدستوري وظيفة المؤسس الدستوري لإنتاج قواعد معيارية سامية وأساسية، بمناسبة تحديث الدستور القائم، وفي هذه الحالة قد يلزم مطابقة الاحكام المعدلة للدستور ضمانا لدستوريتها في حد ذاتها، مما يتيح للمجلس الدستوري فرصة متابعة عمليات تحديث النظام الدستوري ومؤسساته، وإبداء رأيه حول دستوريتها، باعتباره المكلف بالسهر على حماية الدستور وتفسيره، وهذا يضمن الهندسة الدستورية للنظام وطبيعة مؤسساته المرسومة في الدستور. وأهم التعديلات التي مست السلطة التنفيذية في تعديلي سنتي 2008 و2016 للدستور، التخلي عن منصب رئيس الحكومة، وامتلاك رئيس الجمهورية للبرنامج السياسي الوحيد. وعند رقابة المجلس الدستوري لدستورية التعديلين المذكورين؛ برر التحول نحو أحادية السلطة التنفيذية بإعادة التنظيم الداخلي لها، وربط أحادية برنامجها السياسي بوظيفة قيادة الأمة. Abstract: The constitutional amendment is the function of the constitutional founder to produce fundamental normative norms on the occasion of updating the existing constitution, and in this case, it may be necessary to conform the amended provisions of the constitution to ensure its constitutionality in its own right. Thus giving the Constitutional Council the opportunity to follow up the processes of modernizing the constitutional order and its institutions, and to express its opinion about its constitutionality, because is charged with protecting the Constitution and interpreting its principles. This will ensure the constitutional engineering and the nature of institutions established by the founder in the Constitution. The most important amendments touched the executive branch in the 2008 and 2016 amendments to the Constitution, were the abandonment of the post of prime minister, and the president's ownership of the only political program. When the Constitutional Council censored the constitutionality of the two amendments, it has justified the transformation the executive branch to unilateralism by reorganizing it internally, and linking the political program to the function of nation leadership.
