الحماية الاجتماعية لفئة المعوقين في التشريع الجزائري

الملخص
Summary : The disability is one of most important social human problems in the society for this reason it was the subject for a lot of studies in different societies and international organizations Algeria was one of the countries which aim to protect and take in charge the handicapped by many legislations in particulary the law number 09-02 related to the protection and development of handicapped persons and having their rights as the right of protection from the social risks in the frame of its social policy .the unemployed persons are treated with special way which is translated by the texts of the law of social security and make them one of the special categories which benefit from the social security .in another side the handicapped workers are submitted to the applied laws on the normal workers by the consequence the handicapped person become a normal person when he is in the employment world . Résumé: Le phénomène d’ handicap est l’ un des problèmes sociaux humains les plus important dans toute sociétés et qu’ a été l objet d’ intérêt pour plusieurs sociétés et organisation internationales . L ’Algérie était une des pays qui a visé la prise en charge et la promotion des handicapés et surtout les rendre capables d obtenir des privilèges et des droits ,notamment le droit a la protection des risques sociaux dans le cadre de sa politique sociale ou la différence entre les travailleurs et les chômeurs handicapes n ’ont pas des dispositions unifiées pour la protection sociale , les handicapes chômeurs sont traites d une façon différente fixées par les lois de la protection sociale et les classer parmi les catégories spéciales bénéficiant de la sécurité social , par contre les travailleurs handicapes sont soumis aux mêmes disposition appliquées aux travailleurs normaux par conséquence le travailleur handicape devient une personne normale une fois entre dans le monde d emploi et perd la qualité d handicape qui est un cas nécessitant des textes juridiques et des .disposition légales ملخص: تعد ظاهرة الإعاقة من أهم المشكلات الاجتماعية الإنسانية التي لا يكاد مجتمع يخلو منها اذ حظيت باهتمام مجتمعات و منظمات دولية فكانت الجزائر من الدول التي سعت للاهتمام و التكفل بشريحة المعوقين من خلال سنها لجملة من التشريعات لعل أهمها القانون رقم 09-02 المتعلق بحماية الأشخاص المعوقين و ترقيتهم و تمكينهم للحصول على مزايا و حقوق من بينها الحق في الحماية من المخاطر الاجتماعية في إطار سياسته الاجتماعية أين فرق بين العمال و العاطلين عن العمل من المعوقين فلم يوحد أحكام التغطية الاجتماعية لفئات المعوقين فقد عامل العاطلين منهم معاملة متميزة ترجمتها الأحكام الخاصة المقررة في قوانين الضمان الاجتماعي و جعلهم من الفئات الخاصة المستفيدة من الضمان الاجتماعي بينما اخضع العمال المعوقين لنفس الأحكام المطبقة على العمال العاديين ليصبح العامل المعوق شخصا عاديا بمجرد دخوله عالم الشغل فيفقد بذلك ضفة الإعاقة التي هي في الواقع حالة تستوجب نصوص و أحكام خاصة.
