ظاهرة الـتلوث البصري العمراني في الجزائر بين قصور النص القانوني وتقصير أجهزة الرقابة

الملخص
يفترض في أي نصٍ قانوني ينظّم التهيئة و التعمير، أنه تضمّن مجموعة من الآليات الهادفة إلى تنظيم حركة البناء و التوسع العمراني من جميع الجوانب،ومن بين هذه الآليات، تلك الهادفة إلى الحدّ من ظاهرة التلوث البصري في المجال العمراني، وهذا من خلال ضمان الوحدة من حيث المظهر،و البساطة من حيث الحجم ،والترجمة الحقيقية لعادات و ثقافة المنطقة المشيّدة فيها البناية،من خلال الالتزام بالهندسة المعمارية المفروضة قانونا،وعليه فهي أمور يفترض في المشرع الجزائري أنه أوجد من أجل تجسيدها على أرض الواقع مجموعة من الآليات في كل من القانون رقم 90/29 المتعلق بالتهيئة والتعمير المعدّل و المتمم،والقوانين ذات الصلة كالمرسوم التشريعي رقم 94/07 المتعلق بشروط الإنتاج المعماري وممارسة مهنة المهندس المعماري المعدّل. The urban visual pollution phenomena in Algeria between the insufficiency of the legal texts and the failure of supervision systems any legal text regulating the reconstruction is supposed to include a set of mechanism aiming to orgonize the movement of construction and urban expansion for all sides. Among these mechanisims , those aiming to reduce the visual pollution phenomena in the urban area. Through the ensuring of the unity of the appearance , simplfity of the size , and the real translation of the constoms , traditions and culture of the area where the building is set, by adhering to the legal imposed architecture. And so it is supposed that the Algerian legislator has been found , in order to embody it on a set of mechanisims in both the law 29/90 regarding the amended and complementary design and reconstruction and relevant laws as the legislative decree no 07/94 regarding the terms of the architectual production and the practice of the architect modified professio .
