الملخص
الملخص تتناول هذه الورقة البحثية إحدى المسائل الفقهية التي لم تحظ بحقها من البحث والدراسة قديما وحديثا، ويتعلق الأمر بحكم تفاوت الشركاء في ملكية رأس المال وأثره على التصرف، والهدف من ذلك هو إيجاد معيار مناسب لتحديد صاحب الحق الأولى لتولي إدارة الشركة عند كثرة الشركاء وتزاحمهم، وحسم الخلافات بخصوص كيفية اتخاذ القرارات المتعلقة بعمل الشركة، وتوصل البحث إلى جواز تفاوت الشركاء في حصصهم المالية، وأن الأصل فيه أن يكون في شركة العنان، كما يمكن أن يكون في المضاربة الجماعية التي يتعدد فيها أصحاب الأموال، وكذلك عند اجتماع المضاربة والعنان، وعلى أساس التفاوت في الملكية يتحدد الشريك المدير، كما يتحدد نطاق الوكالة الممنوحة له. ABSTRACT :This paper deals with one of the jurisprudential issues that have not been granted the right to research and study in the past and the present. This is due to the variation in ownership of capital and its effect on the disposition.The objective is to find an appropriate criterion to determine the right holder to take over the company, in the matter of how dicisons are taken regarding the work of the company. The research concluded that the partners may be different in their financial shares, and that original is to be in Al-Anan company , it can also be in the collective mudarabah in which the owners of the funds are numerous , as well as at the Mudarabah and Al-Anan meetings. On the basis of the difference in ownership, the managing partener is determined and the scope of agency granted to him is also determined.
