الملخص
الملخص فتح اعتماد ميثاق روما الأساسي المنشئ للمحكمة الجنائية الدولية في 1998، ثم دخوله حيّز النفاذ في 2002، عهدا جديدا أمام القانون والقضاء الجنائي الدوليين، فلأول مرة في التاريخ تنشأ محكمة جنائية دولية دائمة لمحاربة الجرائم الدولية الأشد خطورة على المجتمع الدولي (الجرائم ضد الإنسانية، جرائم الحرب، الإبادة الجماعية والعدوان)، ولتضع حدا نهائيا للإفلات من العقاب. اعتمدت المحكمة مبدأ التكميل القضائي كمعيار يحكم العلاقة بينها وبين القضاء الوطني للدول الأطراف في ميثاقها، هذا المبدأ الذي اعتبره مختصون فكرة عبقرية، استطاعت الحفاظ على سيادة الدول الأطراف وفي نفس الوقت أعطت للمحكمة دورا أساسيا كمحكمة الملجأ الأخير (a court of last resort) لمحاكمة مقترفي الجرائم الأشد خطورة. عبر المبدأ على شراكة وتعاون حقيقيين بين الأسرة الدولية والمحكمة الجنائية الدولية في محاربة الجريمة الدولية والعمل المشترك من أجل وضع حد نهائي لجريمة الإفلات من العقاب وتحقيق ردع عالمي، يعود على المجتمع الدولي بالأمن والسلام والاستقرار والازدهار الاقتصادي. Sammary A new era has opened up to international law and jurisprudence, after the entry into force of the Rome Statute in 2002, which created the ICC (International Criminal Court). It is for the first time in the world that a permanent international criminal court is set up to fight against the most serious international crimes for the international community and to end impunity. The court has adopted the principle of complementarity to manage its relations with the national jurisprudence of the members in its statute. Many specialists in view of "complementarity" a brilliant idea, which was able to safeguard the sovereignty of member states and at the same time gave the court a major role as a court of last resort to try those responsible for the most serious crimes on the scene World. The adoption of the principle of complementarity expressed a genuine desire for collaboration between the international community and the ICC to end impunity and to bring about repression, which engendered security, peace, stability and economic development.
