الملخص

البيئة هي الإطار الذي يعيش فيها الفرد، وهي عرضة للتدهور والتأثر نتيجة تداخل جملة من العوامل، وبغرض الحفاظ على بيئة سليمة اتخذ المشرع جملة من التدابير بغاية حماية البيئة والمحافظة عليها، وذلك من خلال الوقاية من كل أشكال التلوث والأضرار الملحقة بالبيئة وذلك بالحفاظ على مكوناتها، وإصلاح الأوساط المتضررة من خلال بيان الضوابط التي تطبق على المنشآت المصنفة لحماية البيئة، وبغرض اشراك أفراد المجتمع في تدابير حماية البيئة، أقر المشرع الجزائري استخدام التحقيق العمومي؛ الذي يسمح للمواطنين في إبداء رأيهم حول موضوع يتعلق بحماية البيئة، وهو يشكل دعامة أساسية لمبدأ مساهمة المواطنين في اتخاذ القرارات التي تتعلق بالحفاظ على سلامة البيئة. Abstract Environment is the framework in wish the people live; it is vulnerable to degradation as result of several overlapping factors. In order to maintain a healthy Environment, the legislator adopted a number of measures to protect and preserve it. Through the prevention of all types of pollution and damages and to protect its components, and to reform the affected communities through the statement of controls applied to the classified establishments for environmental protection, and to involve members of society in this environmental protection measures, the Algerian legislator approved the use of the public inquiry, wich allows citizens to express their opinion on a topic related to environmental protection. It is a fundamental pillar of a Citizens contribution principle in making decisions related to the safety of the environment.
