الملخص

ملخص لقد شهدت الهندسة للعقود تطورا ملحوظا في السنوات الأخيرة لذلك فان البنوك الإسلامية قد استطاعت أن تحقق نجاحا باهرا، يمكن إرجاعه إلى ابتكارها وتطويرها لهذه المنتجات والعقود المالية الموسومة بالمركبة، والتي يمكن وصفها بأنها ذات كفاءة اقتصادية عالية، إلا أن الكثير من الباحثين يرى أن كفاءة هذه المنتجات كانت على حساب مصداقيتها الشرعية وبعدها التدريجي عن الالتزام بالأحكام والضوابط الشرعية والتي تعتبر أساس عمل البنوك الإسلامية، ولذلك هدفت هذه الورقة البحثية إلى دراسة واقع تطوير وابتكار منتجات مالية لمواكبة النمو المتسارع في الصناعة المالية من خلال الهندسة المالية وقدرتها على تلبية الحاجيات المالية المتنوعة والمتجددة ، وقد تناولنا من خلالها ماهية العقود المالية المركبة واهم العقود المالية المركبة في ظل المالية المعاصرة، إضافة إلى بعض التطبيقات للعقود المالية المركبة الإسلامية واهم ضوابطها وأحكامها الشرعية. Abstract For decades , the Engineering have been witnessed in recent years a remarkable development, so that the Islamic banks have been able to achieve great success, so this can be traced back to the innovation and development of these products and financial contracts called compound , which can be described as highly efficient economically, but many researchers believes that the efficiency of these Products were upon the legitimacy and credibility of the expense of progressive distance from the commitment of the provisions and Legitimacy, which is considered the base of the work of Islamic banks, Therefore the purpose of this paper is to study the reality of development and innovation of financial products to keep pace with the rapid growth in the financial industry through financial engineering and its ability to meet the diverse and renewable financial needs, we have dealt with through essence of financial compound contracts and the most important financial compound contracts under financial contemporary, in addition to some applications of Islamic financial compound contracts and the most important controls and provisions of legitimacy.
