الملخص
تعد جريمة اختلاس الممتلكات العمومية أحد أخطر جرائم الفساد المالي والإداري، وتبعا لخطورتها على المال العام، حاول المشرع اعتماد سياسة جنائية جديدة تهدف إلى تحقيق حماية فعالة للممتلكات العمومية، باعتماده آليات وقائية ضد هذه الجريمة من خلال الهيئات الوطنية المضطلعة بالوقاية منها ومكافحتها، على غرار كل من مجلس المحاسبة والمفتشية العامة للمالية، وكذلك الهيئة الوطنية للوقاية من الفساد ومكافحته والديوان المركزي لقمع الفساد، وكذلك آليات مكافحة هذه الجريمة من خلال وضع إجراءات خاصة للبحث والتحري عن هذه الجريمة كآلية التسرب أي الاختراق والترصد الإلكتروني واعتراض المراسلات وتسجيل الأصوات والتقاط الصور، والحرص على تفعيل آلية التعاون الدولي في هذا المجال من خلال التسليم المراقب واسترداد العائدات الإجرامية. Abstract: The crime of embezzlement of public property is one of the most serious crimes of financial and administrative corruption. Based on this threat to public funds, the Algerian legislator attempted to adopt a new criminal policy aimed at the effective protection of public property through the adoption of preventive mechanisms against this crime through The establishment of the Accounting Council, the General Inspectorate of Finance, the National Anti-Corruption Authority and the Central Office for the Suppression of Corruption, The establishment of special procedures for the search and investigation of this crime, such as the mechanism of leakage, ie penetration and electronic monitoring, intercepting correspondence, recording of votes and taking pictures, and ensuring the activation of the mechanism of international cooperation in this field through controlled delivery and enumeration Criminal proceeds.
