دور الإطار القانوني في مرافقة الإنفتاح السياسي في جمهورية مالي

الملخص
ملخص تعتبر دولة مالي من الدول التي انخرطت في المسار الديمقراطي منذ سنة 1991، و في هذه الدراسة نحاول التطرق إلى مساهمة الإطار القانوني الذي رافق عملية التحول الديمقراطي فيها، وذلك بالتعرض إلى أهم المكتسبات الديمقراطية التي جاء بها دستور 1992، كالفصل بين مؤسسات الدولة وتحديد صلاحياتها والعلاقة بينها، وبعدها ننتقل إلى دراسة القوانين المصاحبة لعملية الانفتاح السياسي، فنتعرض إلى قانون الأحزاب وما احتواه من نقاط تشجع على المشاركة السياسية وتحميها ، كإنشاء الأحزاب وقوانينها الداخلية، وطرق تمويلها بالإضافة إلى خوضها غمار المنافسة الانتخابية والاندماج في الحياة السياسية. ومن ثم نمر للتفصيل في قانون الانتخابات باعتبار أن هذه الأخيرة هي من الآليات المهمة في أي عملية ديمقراطية ، فنتطرق إلى المواد التي حددت الهيئات التي تشرف على تنظيم الانتخابات وصلاحياتها، ثم نمر إلى المواد التي تكلمت عن القوائم الانتخابية وشروط الناخب والمرشح وطريقة إجراء الانتخابات ...وغيرها. وفي الأخير نصل إلى مجموعة من الاستنتاجات نضمنها في الخاتمة. : Abstract The State of Mali is one of the countries that have been involved in the democratic process since 1991 In this study we try to address the contribution of the law which accompanied the process of democratic transition in Mali By exposure to the most important democratic gains which was enshrined in the 1992 Constitution such as separation among institutions of the state and determining its powers and the relationship between them We then proceed to study the laws accompanying the process of political openness We look at the Political Parties Law and its points that encourage and protect political participation Such as the establishment of parties and their internal laws And ways of funding them In addition to running in the electoral competition and integration into political life Then we go to details in the election law As the latter is an important mechanism in any democratic process We treat To the articles that defined the committees that supervise the organization of elections and their powers Then we go to the articles that spoke about the electoral lists and Conditions of the voter and the candidate and How to conduct elections…etc Finally, we arrive at a set of observations that we will include in the conclusion
