قاعدة التنفيذ الحرفي في الإعتمادات المستندية

الملخص
تعد قاعدة التنفيذ الحرفي من أهم القواعد القانونية المستقرة والتي تسود الاعتمادات المستندية باعتبارها المعيار الأساسي الذي يعتمد عليه البنك - منشئا كان أو وسيطا- في فحصه وتدقيقه للمستندات المقدمة إليه من طرف البائع المستفيد، فمن خلالها ينفذ البنك التزاماته بدقة كما يتقيد حرفيا بالشروط المنصوص عليها في عقد الاعتماد وكذا بتعليمات عميله الآمر خاصة إذا كانت هذه الأخيرة واضحة وصريحة، ولا يكون له على ضوء هذه القاعدة أية سلطة تقديرية في التفسير أو الاستنتاج أو التأويل أو حتى تكملة بيانات ناقصة في المستندات أو الاعتداد بأية عناصر خارجة عن عقد الاعتماد، بل أن التزامه يكون في حدود عبارات هذا الأخير ،والدفع للبائع المستفيد يكون فقط لقاء تقديم المستندات المطابقة في ظاهرها لشروط الاعتماد-أي في حالة التطابق الحرفي والتام بين المستندات وشروط خطاب الاعتماد-. وعليه متى ثبت احترام البنك لقاعدة التنفيذ الحرفي ولتعليمات عميله الآمر لا تقوم على عاتقه أية مسؤولية أمام هذا الأخير، وبالتالي يحفظ حقه ومصلحته. Abstract: The literal execution basis is one of the most important stable legal bases which prevails among the Documentary Credits, as it is considered the main standard that the bank relies on (made or intermediary) when examining and auditing documents provided by the payee seller. Through which the bank performs, exactly, its commitments, and complies verbally, with conditions stipulated in the credit deed as well as the instructions made by the customer commander, especially if these documents are clear and explicit, and does not have any estimated authority concerning the interpretation, the conclusion or even completing missing data within the documents or counting on any external elements of the credit deed. However, its commitments will be in the limit of the latter and the payment of the payee seller will be carried out only by introducing the corresponding documents with the credit terms, i.e. in case of the complete literal conformity between documents and the letter of credit terms. So when it is proven that the bank respects the literal execution basis and the customer commander instructions it will relieve oneself of any responsibility, therefore, it preserves its rights and interests.
