الملخص
ملخص: من خلال هذا البحث نسعى لتسليط الضوء على اثر الأبحاث الطبية الحيوية ودور العلماء في إحداث أهم الاكتشافات العلمية في المجال الطبي والتي لم يكن ليتوصل اليها إلا من خلال التجارب، ولان هذه الأبحاث لم تكن تجري إلا على الكائن البشري، فكان امرا محتما البحث عن الأسس التي يسمح من خلالها بتنفيذ الأبحاث الطبية مع احترام حرمه الكائن البشري. والبحث يعقد دراسة تحليلية لقانون الصحة الفرنسي، ولقانون المسؤولية الطبية الإتحادي في دولة الإمارات العربية المتحدة، بهدف بيان آلية تنفيذ الأبحاث الطبية من خلال هذين التشريعين وكيفية حمايتهما لمبدأ حرمة الجسد البشري وعدم جواز المساس به. وهل إكتملت محاور الحماية القانونية للأشخاص المنفذ عليهم البحث في المراحل الثلاثة للبحث الطبي اي قبل تنفيذه وخلال التنفيذ وما بعد التنفيذ حال حصول الضرر. Abstract: Legal Bases that Give Legitimacy to Medical Researches on Human Body A comparative study of French Health Law and Federal Law of Medical Responsibility No:10, 2008 Concerning Medical Research Legitimacy on Human Body. This study shades the light on the effects of medical researches and the role of scientists in the contribution of the most important discoveries concerning medical field which cannot be achieved without their efforts in medical experiments that have done on human body. Consequently, it is inevitably crucial to establish and put rules and laws that restricted the use of human body. This study examines and analyzes French Health Law and Federal Law of Medical Responsibility aiming to show how the medical researchers are done within the framework of these two laws. This study also examines how these two laws protect the privacy of human body and restrict the use of human body throughout the three stages of medical experiment, that is to say, before, through and after the medical experiment in case of damage existence
