الملخص
ملخص المقال باللغة العربية: أولى المشرع الجزائري للعقار ترسانة من القوانين نظرا للأهمية الاقتصادية، الاجتماعية و المالية التي بات يكتسيها، بغرض الوصول لحل لمشكل إثبات الملكية العقارية، عن طريق خلق آليات قانونية للتطهير النهائي للأوعية العقارية، فتم استحداث القانون رقم 07-02 المؤرخ في 27/02/2007 المتضمن تأسيس إجراء لمعاينة حق الملكية العقارية و تسليم سندات الملكية عن طريق تحقيق عقاري، ليحل محل عقد الشهرة ويطبق بالموازاة مع سير عملية المسح العام للأراضي، و الذي هو آلية اختيارية تتضمن جملة من الإجراءات القانونية، منها إجراءات إدارية و أخرى ميدانية تعتمدها الإدارة المختصة، بناء على طلب فتح تحقيق عقاري من قبل المعني بهدف معاينة ملكيته العقارية القائمة على الحيازة القانونية الصحيحة، و ذلك بغرض إعداد وتسليمه سند ملكية عن طريق التحقيق العقاري، بعد توافر شروط معينة منها ما يخص العقار محل المعاينة و التحقيق العقاري، و منها ما يتعلق بالحيازة.
