سلطات الضبط الاداري في مجال حماية النظام العام البيئي

الملخص
ملخص: تتمتع سلطة الإدارة في مجال حماية البيئة، بامتيازات السلطة العامة ومنها سلطة الضبط الإداري ضد النشاطات الضارة بالبيئة، وفي هذا الإطار تمتلك هيئات الضبط الإداري البيئي عدة أساليب لحماية النظام العام، منها أسلوب التنظيم، وتدابير الضبط الفردية المستقلة، كالمنع والترخيص والإخطار المسبق والإزالة، ويمكنها اللجوء إلى التنفيذ المباشر والجبري لقراراتها دون حاجة إلى إذن قضائي. ومن أشدها أيضا الجزاءات الإدارية باعتبارها عقوبة إدارية في شكل غرامات مالية ضد كل ما يضر بالبيئة، وكذا بإلغاء أو سحب الترخيص المتعلق باستغلال منشأة مصنفة. وتوصي الدراسة في الأخير باستثمار فكرة النظام العام البيئي في توسيع سلطات الضبط باعتبارها فكرة متغيرة ومتطورة، تمكن هيئات الضبط من ابتكار وسائل جديدة من شانها منع كل ما قد يضر بمكونات البيئة الطبيعية. Summery In the field of environmental protection, the administration is privileged the public authority including the administrative control authority against activities carried out by individuals and which are harmful to the environment. In this framework, environmental control bodies have several methods of protecting the public environmental system involving the method of organ sing regulations and various individual control measures such as banning, licensing and notification. They can also resort to direct and forced execution of its decisions without the need for judicial permission. One of the most severe administrative sanctions regimes is administrative punishment in the form of fines or confiscation for all harm to the environment as well as the revocation or withdrawal of the license for the exploitation of a classified enterprise. Finally, the study recommends the importance of the concept of environmental public order through the expansion of the control authorities as a changing and evolving idea that enables the control bodies to find new means that will prevent any damage to the components of the natural environment.
