الملخص
The pardon rank or the legislqtive vaccum area is that area rerated to the public and private affairs, which was internationaly let by the legislator without designing its act. So,, the matter is handed over to the rulers and scientists to look for its legislative acts. Than, its scope incounters any new situation that has never been a subject of a direct text or general rule, therfore, methods of islamic scientists differ in treating this legislative vaccum area between two kinds of ijtihad; the first one treated it under the umbrella og legilative judgement concidering that religion surrounds all new subject, then second treated it far from the first one, where the ijtihad is a part of daily life management. Finally, the reality of these judgements is that they are legislative judgement and at the same time managing ones.
