حماية الاعتبار الشخصي في العقود الالكترونية - دراسة مقارنة

الملخص
ملخص: رغم أن وجود الاعتبار الشخصي في العقود والذي يتمثل في الثقة المتبادلة بين أطراف العقد قد ارتبط ظهوره مع عقود الشركات التجارية لاسيما شركات الأشخاص، إلا انه قد أصبح موجودا في العقود الالكترونية كذلك، وله أهمية بالغة، لاسيما أن هذه العقود قد تتجاوز حدود الدول مما يزيد من المخاطر التي تؤثر على مصالح المتعاقدين، وقد رصدت عدة دول وسائل حمائية للاعتبار الشخصي للمتعاقدين الكترونيا ظهرت مع بروز وتطور العقود الالكترونية، وتتمثل في الكتابة والتوقيع الالكترونيين، وكذلك تقنية التشفير، وهيئات التصديق الالكتروني، والتي تحمي الثقة بين المتعاقدين مما يعزز الاعتبار الشخصي في العقود الالكترونية، وقد اعترف المشرع الجزائري ببعضها متأثرا ببعض التجارب الدولية. : Abstract Al though the presence of personal consideration in the contracts, which is the mutual trust between the parties to the contract has been associated with the emergence of contracts with commercial companies, especially companies of persons, But it has also existed in electronic contracts and is of great importance, especially as these contracts may exceed the borders of States, which increases the risks that affect the interests of contractors. Several countries have monitored the protection of the personal consideration of electronic contractors emerged with the emergence and evolution of electronic contracts, Write and sign electronic, as well as encryption technology, and electronic certification bodies, which protect trust between contractors, thus enhancing personal consideration and establishing confidence in electronic contracts. The Algerian legislator has recognized some of them from some international experiences.
