الشروط الشكلية والموضوعية لقبول دعاوى عقود التعمير Formal And Objective Conditions In Order To Accept Construction Deeds Actions

الملخص
إن عقود التعمير هي عبارة عن تراخيص إدارية تسمح للأفراد بممارسة مختلف الأنشطة العمرانية على ملكياتهم العقارية وقد يحدث أن تتعسف الإدارة في منح هذه العقود مما يضطر صاحب المصلحة إلى رفع دعاوى أمام القضاء من اجل إلغاء قرارات الإدارة غير المشروعة أو الحصول على تعويض عما أصابه من ضرر، إلا أن أهم مسالة يمكن إثارتها في دعاوى عقود التعمير هي البحث عن الشروط الشكلية والموضوعية لقبول هذه الدعاوى ذلك أن القاضي الإداري لا ينظر في موضوع الدعوى حتى يبحث في شروطها الشكلية. Construction deeds are considered as administrative authorizations, which permit to individuals to practice the various urban activities on their real estate, the administration can be arbitrary when it delivers these deeds this matter push the head of the department to introduce an action before the justice in order to annul the illegal administrative decisions or the obtaining of a compensation concerning the injury which he has endured, but the important problem which we can expose in the construction deeds actions is to search the formal and the objective conditions in order to accept these actions , because the administrative judge does not examine the objective of the actions until he searches its formal conditions.
