الملخص
تهدف الدولة من خلال المنافسة الحرة كمبدأ إلى دفع المؤسسات إلى العطاء، وتقديم أفضل ما لديها من سلع وخدمات، لذلك كرس المشرع الجزائري دعائم الوقوف على أسس سليمة للممارسات التجارية من خلال حماية العون الاقتصادي – باعتباره فاعلا أساسيا-من مختلف الممارسات التجارية التي تحول دون تفعيل ديناميكية السوق. ويعتبر التعسف في استغلال وضعية التبعية الاقتصادية في السوق إحدى الممارسات المنافية للمنافسة التي حظرها المشرع الجزائري، وتهدف هذه الدراسة إلى التعرف على القواعد القانونية الخاصة بهذه الممارسة الواردة ضمن الأمر 03-03 المتعلق بالمنافسة المعدل والمتمم، مع الاستئناس في كل ذلك بالتجربة التشريعية والفقهية الفرنسية لاعتماد المشرع الجزائري عليها في مكافحته هذه الممارسة، ولعراقتها في هذا المجال مقارنة بالتجربة الجزائرية الحديثة نوعا ما.
