الملخص
ملخص قرّرت لجنة القانون الدولي، في دورتها الخامسة والستين المعقودة في عام 2013، أن تُدرج مواضيع القانون الدولي الجنائي وخاصة الجرائم الدولية ضمن برنامج عملها الطويل الأجل، والهدف من هذا هو بحث المنافع التي يُحتمل أن تعود من عملية تدخل اللجنة في وضع مشاريع مواد قد تُشكِّل أساسًا لتطبيق الاتفاقيات الدولية ذات الصلة بالجرائم الدولية، وعلاقة ذلك بمضمون القواعد الآمرة، خاصة في صلب بحثها في مجال المسؤولية الدولية للدول والمسؤولية الجنائية الدولية للأفراد عن انتهاكات تقع تحت طائلة القانون الدولي الجنائي، ومدى احتياج الموضوع إلى نظام القواعد الآمرة ليكتمل تحقيق المبتغى منه، وهو ما أظهرته اللجنة من خلال تقاريرها وحولياتها المختلفة، لذا فإن المهم من تقديم هذا البحث هو محاولة إيجاد تفسير لمفهوم القواعد الآمرة في القانون الدولي الجنائي وصلة ذلك بالنظام الأساسي للمحكمة الجنائية الدولية. Abstract Decided the International Law Commission, at its sixty-fifth session in 2013, to include the topics of international criminal law and private international crimes within the long-term program of work, and the aim of this is to examine the benefits that are likely to come back from the process of intervention of the Commission in the draft articles may serve as a basis for the application of the relevant international crimes of international conventions, and its relation to the content of peremptory norms, especially in the core of her research in the field of international responsibility of States and international criminal responsibility of individuals for violations of international criminal law, and how desperate subject to peremptory norms system to complete the achievement of the desired of it, which is shown by the Committee of through their respective reports and annals, so it is important to provide this research is to try to find an explanation for the concept of jus in international criminal law rules and link it to the Statute of the International Criminal Court.
