عمليات نقل الدم بين الأحكام الشرعية والأنظمة الوضعية في الجزائر

الملخص
ملخص: تميزت نهايات القرن الماضي بظهور أمراض قاتلة تنتقل عن طريق الدم لعل أخطرها مرض نقص المناعة المكتسبة (الايدز)، والذي صنفته المنظمة العالمية للصحة من بين أشرس عشر أمراض قاتلة لذلك فإنه من المهم جدا إلتزام واجب الحيطة والحذر أثناء نقل الدم لتجنب نقل العدوى، وهو ما يجعل الأطباء مسؤولون عن تلك الأضرار حال تحققها . وعليه ستتناول هذه الدراسة بالبحث في مدى مشروعية عمليات نقل الدم وفق دراسة مقارنة تحليلية لموقف الشريعة والقانون من هذه العمليات، يدفعنا في ذلك حدة الجدل حول مدى مشروعية تلك التصرفات الواردة على دماء الإنسان، أين نعرج على موقف كل من القوانين المقارنة عموما و القانون الجزائري بالخصوص. Résumé: A la fin du XXe siècle، Le monde a vu l'émergence des maladies mortelles، Qui peuvent être transmises par le sang، à leur tête; le VIH (SIDA)، qui a été classée par l'Organisation mondiale de la santé parmi les dix premiers grands tueurs، et du coup nous ne pouvons pas négliger les fautes relatives a la transfusion sanguine. En conséquence، cette étude examinera les dispositions relatives à la responsabilité de transfusions sanguine، et ce dans une étude comparative et analytique entre le droit positif et de la loi islamique(charia)، En fait la controverse sur la légitimé d'un tel comportement relatif à la transfusion de sang، nous mène au passage en revue de la position de chacun du droit comparé et le droit algérien. abstract: In the late of the twentieth century، the world has witnessed the emergence of deadly diseases that can be transmitted through blood، especially the HIV (AIDS)، which has been classified by the World Health Organization one of top ten killers، so we can not overcome those mistakes in the field of blood transfusions. Accordingly، the present comparative study has on subject the position of Islamic and comparative law vis- à- vis this operations. This study leads us to the controversy on the legality of such behavior in the human blood، where we review the position of each the Comparative law and the Algerian law.
