الملخص
ملخص: مرت رقابة قاضي الإلغاء على السلطة التقديرية للإدارة بمراحل و خطوات حسب تطور نشاط الدولة، بدأ بالرقابة العادية بأساليبها العامة على الوجود المادي و القانوني للوقائع و صحة التكييف القانوني، و أساليبها الخاصة بفحص التناسب. إن سلاح قاضي الإلغاء هو تبنيه لأساليب عامة و خاصة في الرقابة العادية على السلطة التقديرية للإدارة ، و يساهم في تقييدها و تنظيمها و تحديد مجال توسعها، بالقدر الذي تسمح به الظروف حماية للحقوق و الحريات العامة ، مع عدم التضييق التام على نشاط الإدارة ، مما يجعل قرارات الإدارة التقديرية لا تفلت من أية رقابة. Abstract: The magistrate's control over the discretionary power of the administration has passed through several stages and steps according to the development of the state's activity. It began with the regular supervision of its general methods of physical and legal existence of the facts and the validity of its legal adaptation and its methods of examining proportionality. The abolitionist's weapon is adopted by public and private methods in the ordinary control over the discretionary power of the administration, and thus contributes to its restriction, organization and expansion, to the extent that circumstances permit the protection of public rights and freedoms, Which makes discretionary management decisions do not evade censorship.
