إشكالية الموازنة بين حرية الإعلام وحسن سير العدالة

الملخص
The aim of both media and justice is to achieve “a juridical country “and to stump the values of equality and justice in front of law. However, to reach that we must have an independent justice and a free media considering that those features are among the pillars of democratic regimes in nowadays. The cooperation between judiciary and media is very important in confronting the abuses, the first one intervenes by sanctioning the transgressors, and the second one by wide informing the public opinion. The coexistence of these poles cannot be always realized for two principal reasons: The first is the differences in the functional rules that governs each one of them. The second is that the freedom boarders of the media are very hard to draw, because media rejects and refuses any restrictions on their work, they consider themselves as the guardian of democracy, that why they have to pay attention in dealing with judiciary cases, they have to act without affecting public opinion nor harming the justice processes which is considered as the guarantee of citizens’ rights.
