Résumé

Résumé : La protection de l’environnement pendant les conflits armés constitue une préoccupation de plus en plus inquiétante pour la société internationale vue la menace que présente l’emploi de la technologie et la technicité dans la guerre. Les instruments internationaux adoptés dans ce sens sont largement critiqués en dépit de la reconnaissance préalable du rôle progressif qu’ils jouent dans l’édification d’un système de sauvegarde des composants minimum du milieu naturel sur lequel les hostilités se déroulent. Parmi les obstacles spécifiques entravant l’application des conventions internationales signées dans cette perspective on cite la contradiction entre ces dernières au terme de critères de l’applicabilité et de conditions requises pour établir la responsabilité internationale avec les deux faces : civile et pénale. Abstract: Environment is deemed the first long range victim of armed conflicts, whereas the international society gives this common framework more importance because of risks which threaten its integrity, especially in the era of the anarchical use of technologies during belligerences; however scholars knowledge the positive contribution presented by international treaties to enhance the protection of environment during armed conflicts. Among the obstacles which stand in the way of the entire application of these conventions, we mention the question about criteria on which the consideration of damages is based on; and the issue of conditions required to establishing the international responsibility even civil or criminal.
