الملخص
الملخص: يقتضي اللجوء إلى المركز الدولي لتسوية منازعات الاستثمار جملة من الضوابط والشروط؛ تتعلق بأطراف النزاع، فالدولة المضيفة كشخص من أشخاص القانون الدولي العام، تكون طرفاً سواء مباشرة أو بأحد وكالاتها، والمستثمر الأجنبي كشخص خاص، سواء طبيعي أو معنوي، إضافة إلى دولة المستثمر. وهناك ضوابط شكلية تتعلق بأن يكون إجراء اللجوء إلى المركز كتابةً، وضوابط موضوعية بحيث ينعقد اختصاص المركز لتسوية المنازعات ذات الطابع القانوني والاستثماري؛ والملفت في اختصاص المركز أن اتفاقية واشنطن لسنة 1965 منحت المستثمر الأجنبي فاقد الشخصية القانونية الدولية أحقية مجابهة الدولة المضيفة أمام هيئات التحكيم التابعة للمركز، وأبقت على الاختصاص الإقليمي للدولة المضيفة بشكل إرادي والاختصاص الشخصي لدولة الجنسية في حال امتناع الدولة المضيفة عن تنفيذ أحكام التحكيم Abstract : The International Center for Settlement of Investment Disputes (I.C.S.I.D ) is regulated by certain conditions and rules relatedto contracting parties. The host country, as a person of public international law, constitutes a party even directly or by its agencies, Thus, the foreign investor as a private person, natural or moral, in addition to that the state of nationality. On one hand, there are formal rules relating to the process to present the dispute by writing in the center. On the other hand, there are some objective conditions, whereas the competence of the center to settle disputes of legal and investment character, the important thing about the competence of the center is to give to the foreign investor, who has not the international legal personality, the right to confront the host state in the arbitration courts, and it stays the territorial competence of the host state as a volunteer act and the personal competence of the nationality state if the host state abstains to execute the judgments of the arbitration.
