الملخص
تهدف السياسة الجنائية المعاصرة إلى إصلاح الجناة وهذا لم يتحقق مع العقوبات السالبة للحرية نظرا للأعداد الهائلة من نزلاء السجون، الأمر الذي أبعد هذه الأخيرة من لعب الدور الذي أنشئت من أجله والمتمثل أصلا في العمل على إعادة الجناة إلي وضعهم الطبيعي بإدماجهم في المجتمع. أمام هذا الوضع الخطير بدأ التفكير والبحث عن وسائل وبدائل إصلاحية تحفظ كرامة الإنسان من جهة وتساعده على الإندماج في المجتمع بسرعة من جهة ثانية الشيئ الذي جعل الدول تراجع منظوماتها العقابية تماشيا مع الصكوك الدولية الملحة على أنسنة العقاب باستعمال عقوبات بديلة عن الإحتجاز ومن بين هذه البدائل عقوبة العمل للنفع العام التي تبنتها الجزائر بموجب القانون رقم09/01 المؤرخ في 25 فيفري2009 المعدل والمتمم لقانون العقوبات الصادر بموجب الأمر رقم:66/156 المؤرخ في 08 جوان 1966. The modern criminal policy aims to rehabilitate criminals, a purpose which custodial sentences has not enabled to achieve given the tremendous number of the inmate population, thus, such phenomenon prevented theses custodial sentences to address their goal consisting actually of assisting offenders in recovering their natural condition through social integration. Faced with such alarming reality, consideration has been given to the implementation of alternative corrective measures aiming to preserve human dignity and to support the offender in his earlier social integration. In this intent, the Governments managed to reform their criminal systems to meet the international instruments emphasizing the need to humanize the custodial sentences by way of alternative punishments, among which community service sentence enacted in Algeria under the Act 09-01 of 25th February 2009 as amending and supplementing the criminal code made enforceable under Ordinance No 66/156 of 8th June 1966.
