نسب الطّفل غير الشّرعي بالبصمة الوراثيّة

الملخص
لاشك أنّ موضوع النّسب من القضايا التي لها خطر كبير، فجعلته الشّريعة الإسلاميّة مستنداً إلى الحقيقة الواقعيّة الصادقة والممتدّة من الآباء إلى الأبناء؛ إذ جعلت الزّوجية الأصل المنشئ للنّسب من خلال توثيق عقد الزّواج بالشّهادة. لكن طبيعة الإنسان النّقص والخطأ لذا فقد ينحرف الإنسان وتنشأ علاقة غير شرعيّة بين رجل وامرأة فيتورّطا في ارتكاب جريمة الزّنا، وقد يتنكّر الرّجل من الولد ثمرة هذه العلاقة الآثمة؛ غير أنّ التّطور العلمي الحاصل في علم الوراثة وفي مقدّمتها البصمة الوراثيّة يمكن حل هذه المشكلة الاجتماعيّة، باعتبارها وسيلة لا تكاد تُخطئ في التّحقق من الوالديّة البيولوجيّة. والبحث يعالج في هذا الباب قضيّة نسب الطّفل غير الشّرعي بالبصمة الوراثيّة، حيث تطرّقتُ إلى تعريف النّسب ومفهوم البصمة الوراثيّة، ثمّ بيّنتُ منهج العلماء في إثبات نسب ولد الزّنا من الزّاني، وانتهيتُ إلى بيان أثر البصمة الوراثيّة في اجتهاد العلماء المعاصرين في إثبات نسب الطّفل غير الشّرعي. Abstrect: There is no doubt that the subject of attribution is one of those issues that have a significant risk. Thus, the Islamic law has made it depended to the real and sincere truth handed down from parent to child; as it made from marriage the origin creating the attribution through the registration of marriage by testimony. But all humans have weaknesses and make mistakes, so they may deviate and an illegal relationship may be established between a man and a woman and they commit adultery, then the man may refuse to recognise the child resulted from this illegal relationship; However, the scientific development in genetics, particularly the DNA Fingerprinting, a remedy to this social problem has become possible, and it is considered as an infallible means to now the biological parent. This research treats the issue of attribution of the illegitimate child with the DNA Fingerprinting, where I outlined the definition of attribution and the concept of DNA Fingerprinting, then I clarified the method used by scientists to prove the attribution of the adulterine child, then I concluded by showing the effect of the DNA Fingerprinting on the modern scientists efforts in proving the attribution of the illegitimate child.
