دور سلطة ضبط الخدمات العمومية للمياه في ضبط قطاع المياه في الجزائر

الملخص
استحدث المشرع الجزائري هيأة جديدة، أوكلت لها مهمة مراقبة أداء الشركات العمومية والخاصة، التي تعمل في قطاع المياه، هذه الهيئة اصطلح على تسميتها "سلطة ضبط الخدمات العمومية للمياه"، ونظمها المرسوم التنفيذي رقم 08 / 303 المؤرخ في 27 سبتمبر 2008 والمحدد لصلاحيات وكذا قواعد تنظيم سلطة ضبط الخدمات العمومية للمياه وعملها، والذي يعد سابقة، لكونه يتحدث لأول مرة عن ضبط العلاقة بين المؤسسة المكلفة بتسيير سوق المياه من جهة، وبين الزبائن على اختلافهم، أشخاصا معنويين كانوا أو طبيعيين من جهة أخرى، إذ تسهر هذه الهيئة على السير الحسن للخدمات العمومية للمياه، والسهر على مدى احترام أصحاب الامتياز، الموكلة لهم الخدمات العمومية للمياه، للالتزامات الموكلة لهم، وكذا دراسة شكاوى المتعاملين، أو مستعملي الخدمات العمومية للمياه، وصياغة كل التوصيات المناسبة. Le législateur Algérien a introduit un nouvel organisme, chargé de contrôler la performance des sociétés publiques et privées, travaillant dans le secteur de l’eau. Cette entité dénommée » , est organisée par le décret n° 08-303 décret en date du 27 Septembre 2008 fixant les attributions ainsi que les règle d’organisation et de fonctionnement de l’autorité de régulation des services publics de l’eau. Ce décret parle pour la première de la régulation de la relation entre l’établissement en charge de la gestion du marché de l’eau d’une part, et les différents clients (Les personnes morales ou naturel ) d’autre part. Cet organisme assure le bon fonctionnement des services publics d’eau, et assure le respect des franchisés, de leurs obligations , ainsi que l’étude des doléances des clients ou des usagers des services publics de l’eau, et la formulation de toutes les recommandations appropriées. The Algerian parliament has introduced a new agency, responsible for monitoring the performance of public and private companies working in the sector of water. This entity known as “the regulatory authority of the public service of water" , is organized by the decree n° 08-303 decree dated 27 September 2008 determining the functions and rules of organization and functioning of the public services of the water regulatory. This Decree is a first, since that he speaks for the first time in the regulation of the relationship between the institution in charge of the management of the market of water on the one hand, and different clients on the other hand. This organization ensures the proper functioning of the water utilities, and ensures compliance of franchisees, their obligations, as well as the study of the grievances of customers or users of water utilities, and the formulation of appropriate recommendations.
