الملخص
الملخص يهدف مبدأ استقلالية السلطة القضائية في أي نظام دستوري إلى تحقيق العدالة في أقصى صورها. كما أن هذا المبدأ أصبح مرتبطا، إلى درجة كبيرة، بحماية الحقوق والحريات في العالم المعاصر. لذلك أصبحت له أهمية كبيرة تطلبت من المشرع الدستوري التدخل لمحاولة حمايته وتعزيزه بأكبر الضمانات الدستورية والقانونية الممكنة. تهدف هذه الدراسة إلى معرفة هذا المبدأ الدستوري الهام'' مبدأ استقلالية السلطة القضائية '' بوجه عام، من خلال دراسة مفهومه واركانه ووسائل تعزيزه، ثم التطرق إلى السلطة القضائية في النظام الدستوري والقانوني العربي والجهود العربية للالتزام بالمبدأ، ثم العقبات التي قد تقف في وجه هذا الالتزام، والحلول والاقتراحات لتدعيم هذا المبدأ في الدول العربية، معالاشارة إلى الجزائر في كل نقطة من الدراسة. وكانت نتائج الدراسة هي أن هناك صعوبات وتحديات تواجهها الدول العربية في سبيل ارساء هذا المبدأ في الواقع.ورغم بعض النتائج المشجعة التي تحققت، وإن كان أغلبها نظريا أكبر منه عمليا، لكن يبقى ذلك يحتاج إلى تشجيع دائم، بحيث يجب السعي إلى استقلالية تامة للسلطة القضائية عن بقية السلطات،ويكون ذلك من خلال تكوين الكادر القضائي تكوينا جيدا واعتناق الرقابة القضائية على دستورية القوانين في الدول العربية، وخلق مساحة من التعاون الاقليمي العربي والدولي في المجال القضائي. Abstract: The principle of the independence of the judiciary in the constitutional Arabic systems: Analysis study and evaluation with reference to the Algerian constitutional system. The aim of the principle of judiciary’s independence in any constitutional system is to realise extreme justice. This principle also became linked largely, to the protection of rights and freedoms in the contemporary world. This great importance required the intervention of the constitutional legislator to protect and promote the principle by constitutional and legal guarantees. The aim of this paper is to study this principle in General through the study of the concept, its pillars and means of promotion. Additionally, I will treat the Judiciary System in Arab states and its efforts to adhere to the principle not forgetting the obstacles that may stand in the way of this commitment, solutions and suggestions for strengthening this principle, with reference to Algeria in each point of the study. The results of the study were that there are difficulties and challenges facing Arab States in applying this principle. Despite some encouraging results, mostly theoretical, more continuous encouraging efforts are needed to reach the final aim. A very professional staff of judges as well as a judicial oversight on the constitutionality of laws and a very tight regional and international cooperation in the judicial field will help on the final run.
