الواقعية في الاجتهاد الفقهي عند المالكية

الملخص
يوصف المذهب المالكي بأنه واقعي وذرائعي ومصلحي، ذلك أنه يأخذ بجميع الأصول التي تستمد من الحياة الاجتماعية، والتي تبرز أسرار الشريعة الإسلامية، فهو يربط الأصول الشرعية بمصالح الناس بعيدا عن التنظير غير الواقعي، مما جعله قريب إلى الفطرة الإنسانية التي يشترك فيها كل الناس. وفي هذ البحث بيان للأصول التي يستند إليها الإمام مالك وعلماء المالكية في استنباط الأحكام الشرعية والفتاوى للنوازل التي تحدث للمسلمين، وكيف ينظرون إلى روح النص ومآله في تحقيق المصالح الاجتماعية وبيان ذلك بأمثلة توضيحية. Abstracts The Maliki method is said to be realistic and of pretexts because it depends on the foundations which refer to the social life and shows the secrets of the Islamic sharia. It links the foundations of the Sharia with people`s needs far from non-realistic designation.That`s why it is closer to the human nature. In this article,there is an exposition of the principles on which the Imam Malik and the Maliki followers rely in deducing Sharia judgements and the Fatwa for recent happenings.How they would envisage the spirit of the text and its tendency to achieve social benefits supporting all that with justifying examples.
