The Impact Of Digital Transformation On Individual Privacy: Exploring The Question Of Socio-legal Frameworks And Boundaries

الملخص
استهدفت الدراسة الراهنة مقاربة مختلف الرهانات السوسيوقانونية والتقنية التي تطرحها التقنيات الرقمية -وتوسعها المجالي والاستعمالي في المشهد الفردي والجمعي للمستخدمين -على مفهوم الخصوصية كمبدأ وكممارسة من زاوية نقدية وميتا-نظرية. وركزّ القسم الأول من الدراسة على البحث في المعاني الابستمولوجية والشروط الانطولوجية لمفهوم الخصوصية ومحاولة حصر معناها الدقيق ضمن نطاقها المعجمي والتداولي. كما تطرقت الدارسة لسياقات التطور التاريخي والكرونولوجي لتحول مسار الخصوصية من الخصوصية كمفهوم مجرّد وفلسفي إلى الحق في الخصوصية كمفهوم مُمأسس، مرورا بالترسانات والمساطير القانونية التي كُرست لهذا الحق ووفرت له السنّد التشريعي والاجرائي. وتناولت الدراسة من منظور شامل واستقصائي جملة الرهانات والتهديدات التي تطرحها التحولات الرقمية على حقوق الأفراد في الخصوصية ضمن المساحات الديجتالية التي يرتبطون بها خصوصا في ظل التوجه الكلّي نحو الاعتماد على التكنولوجيات الرقمية والتي يتضاءل فيها منسوب الشفافية وكذا الضمانات الفعالة والكافية لحماية الخصوصية. The current study aimed to approach the various socio-legal and technical stakes presented by digital technologies and- their usage expansion in the individual and collective landscape of users- on the concept of privacy as a principle and as a practice from a critical and meta-theoretical angle. The first part of the study focused on investigating the epistemological connotations and ontological conditions of the concept of privacy and trying to delimit its precise meaning within its lexical and terminological scope. It also explored the historical and chronological contexts of privacy's evolution from an abstract philosophical concept to an institutionalized right, including the legal frameworks and procedures that have shaped and supported this transition. The study addressed equally, from a comprehensive and investigative perspective, the challenges and threats posed by digital transformations to individuals’ rights to privacy within the interconnected, especially in light of the overarching trend towards dependence on digital technologies, in which the level of transparency is critically diminishing, as well as the effective and sufficient measures to safeguard privacy.
