The Role Of Smart Automation In Protecting Marine Public Properties

الملخص
Résumé Le législateur algérien n'est pas intervenu pour établir des règles protectrices modernes pour les domaines publics maritimes et s'est contenté des règles classiques établies par le législateur français, qui n'ont pas atteint les objectifs souhaités jusqu'à ce jour. Dans le contexte du développement rapide de l'automatisation et de l'intelligence artificielle générative, il convient de s’interroger sur l'importance de ces technologies en vue de fournir la protection "manquante" des biens publics maritimes naturels. Cet article vise à explorer comment l'automatisation et l'intelligence artificielle peuvent être mobilisées pour protéger les domaines publics maritimes et à évaluer leur efficacité dans ce domaine. Abstract The Algerian legislator did not intervene to establish modern protective rules for maritime public properties and was satisfied with the classic rules established by the French legislator, which have not achieved the desired objectives to date. In the context of the rapid development of automation and generative artificial intelligence, it is worth questioning the importance of these technologies in providing the "missing" protection of natural maritime public properties. This article aims to explore how automation and artificial intelligence can be mobilized to protect maritime public properties and to assess their effectiveness in this area. ملخص لم يتدخل المشرع الجزائري لوضع قواعد حمائية حديثة للاملاك العمومية البحرية وأكتفى بما أسسه المشرع الفرنسي من قواعد كلاسيكية لم توفر الى غاية اليوم الاهداف المرجوة منها، ففي ظل التطور المتسارع للأتمتة و الذكاء الاصطناعي التوليدي يجدر التساؤل عن أهمية هذه التقنيات في توفير حماية " مفقودة " للاملاك العمومية البحرية الطبيعية؛ تهدف هذه الورقة البحثية إلى التعرف على كيفية تسخير الأتمتة والذكاء الاصطناعي لحماية الأملاك العمومية البحرية، وتقييم مدى فعاليتها في ذلك.
