التَّحقيقُ في مسألة دفعِ المرأة زكاة مالها لزَوْجِها الفَقير دراسة فِقهيَّة مقارنة

الملخص
مسألة:" دَفْع المرأة زكاة مالها لزَوْجِها الفقير " من المسائل الفِقهيَّة التي تضاربت حول حُكمها اجتهاداتُ الأعلام، وعَظُمَ السُّؤال عن مَدَى جواز ذلك في هذه الأيَّام، خاصَّة من قِبَل بعض الدَّهماء والعوام. فتأتي هذه الورقةُ البَحثيَّة لدراسة المسألة دراسة موضوعيَّة مُقارنة بين المذاهب وآراء العُلماء، وذلك بسَردِ الأقوال وبيان الأدلَّة وتجليَّة المدافعات الواردة على هاذيك الاستدلالات، للوُصولِ إلى القول المختار. وتَتَغَيَّا هذه الورقات الدَّعوة الجادَّة إلى وُجُوبِ تقدير المدارس الفِقهيَّة واحترامها، والنَّهل العَذْبِ من معارفها دون التَّعصُّب المذموم لاجتهاداتِ أعلامها، كما تَرومُ هذه السُّطور كيفيَّة بناء العقل الفقهيّ الجسور، القائم على استشراف أقوال الأئمَّة عبر مختلف العُصُور، المُحتكِم إلى قواعد التَّدليل والتَّعليل. The issue: “A woman paying the zakat on her wealth to her poor husband” is one of the jurisprudential issues over which the jurisprudence of prominent scholars has conflicted, and there is a great deal of question about the extent to which this is permissible these days, especially from some of the demagogues and the common people. This research paper aims to study the issue in an objective, comparative study between the schools of thought and the opinions of scholars, by narrating the statements, clarifying the evidence, and clarifying the defenses contained in these inferences, in order to arrive at the chosen statement. These papers are invoked by the serious call to the assessment and respect of the jurisprudence schools, and the fresh time from their acquaintances without the disgraceful fanaticism of the jurisprudence of their flags, as these legends are how to build the jurisprudence of the jurisprudence, the bridges, which are based on the anticipation of the sayings of the imams Night and explanation.
