Abstract: God Almighty willed for Algeria to follow the doctrine of Imam Malik bin Anas, may God Almighty have mercy on him, The Maliki school of thought was distinguished by its unique outlook on many jurisprudential chapters, including the chapter on waqfs. In defining the waqf, he differed from other schools of jurisprudence, and differed from them in some of the waqfs. The aim of this research is to examine the extent to which the Algerian Awqaf Law is affected by these Maliki views on waqfs. To achieve this goal, the comparative approach was used to compare between the Maliki school of thought and other schools of thought in defining the waqf and its characteristics, on the one hand, and between it and what was decided by Algerian law, on the other hand, without neglecting the descriptive approach and the analytical approach. The research concluded that the observer of the Algerian Endowment Law does not notice that Maliki character in the endowment provisions codified therein, but rather it was greatly influenced by the Hanafi doctrine, especially the opinion of the students of Imam Abu Hanifa, although many contemporary scholars prefer the Maliki opinion in a number of these controversial issues. . Perhaps he has a reason for this choice
