الحياة الخاصة بين القانون الجزائري والفقه الاسلامي

الملخص
ملخص: جاءت الشريعة الاسلامية بنصوص في غاية الأهمية في مجال حماية الحق في الحياة الخاصة، والتي من شأنها أن تجعل الإنسان يعيش في سكينة، نصوص وضعت سياجا محكماً وحصنا منيعاً ضدّ من يحاول اختراق خصوصياته أو هتك أسراره، بأي شكل من الأشكال، جاءت هذه النصوص قاطعة في تحريم اقتحام البيوت، أو التجسس على الناس أو محاولة إفشاء أسـرارهم ومراسلاتهم وتتبع عوراتهم، إلاّ أنّها قيّـدت هذا الحق في حالات الضرورة، وهذا لحمايـة المجتمع وتأمين سلامته. وقد ضمّنا البحث أهمّ ما يتعلّق بالموضوع من حيث التفصيل في المظاهر والضّمانات والضّوابط والقيُود. ولقد تأثّرت القوانين الحديثة بالقواعد والنصوص الشرعية، وأخذت الكثير ممّا تضمنته من معاني. ومن الناحية القانونية عرّجنا على تعريف حق حرمة الحياة الخاصّة، والتّأصيل القانوني لها، وموقف المشرّع الجزائري، والتطوّر التّاريخي للمفهوم، وأهمّ أنواع الخصُوصية المتعلّقة بها. صدق الله العظيم إذ يقول: (( ولقد كرّمنا بني آدم وحملناهم في البرّ والبحر ورزقناهم من الطّيبات وفضّلناهم على كثيرٍ ممّن خلقنا تفضيلا )) سورة الإسراء، الآية70 Abstract: Islamic law came with very important texts in the field of protecting the right to private life, which would make a person live in peace. Texts that placed a tight fence and an impenetrable fortress against anyone who tried to penetrate his privacy or violate his secrets, in any way. These texts came categorically in It prohibits breaking into homes, spying on people, or trying to divulge their secrets and correspondence, or tracking down their private parts. However, it restricts this right in cases of necessity, and this is to protect society and ensure its safety. The research included the most important things related to the subject in terms of detail in aspects, guarantees, controls and restrictions. Modern laws have been influenced by legal rules and texts, and have taken on many of the meanings they contain. From a legal perspective, we discussed the definition of the right to the inviolability of private life, its legal foundation, the position of the Algerian legislator, the historical development of the concept, and the most important types of privacy related to it. God Almighty is truthful when He says: ((And We have honored the children of Adam and carried them on land and sea and provided them with good things and favored them over many of those We created with a great preference)) Surah Al-Isra, verse 70.
