الملخص: تتناول هذه الورقة البحثيّة موضوع الجنين المشوّه من خلال بيان حكم إسقاطه والنّظر في الحجج التي قدمها كل من المجيزين والمانعين، ومناقشة كلا الفريقين للتوصل للرأي الرّاجح في المسألة، معرّجين في أثناء ذلك على رأي الفقهاء القدامى في إسقاط الجنين عموما والأضرار الناجمة عن الإجهاض بالنسبة للأم وغيرها من الأطراف، مع بيان درجة التشوّه التي هي محلّ النّزاع، ومن بين أهم النتائج المتوصل إليها حرمة إجهاض الجنين المشوّه مطلقا مهما بلغت درجة التشوّه إلا إذا عرّض حياة الأم للخطر. ABSTRACT: This research paper addresses the topic oft he deformed fetus by examining the rulings on its abortion according to both ancient and contemporary scholars. It analyzes the arguments presented by proponents and opponents engaging in a comprehensive discussion to arrive at the prevailing opinion on the matter.The paper explorer different types of abortion,the reasons leading to it, and its classifications. Additionally, it outlines the causes of fetal deformities, methods of identification, the degree of deformity that permits abortion, and the reasulting harm to the mother and other. Throughout this exploration, the paper references the statements of jurists and consensus among legal authorities, drawing on insights from modern medicine.
