النظام القضائي الإداري الجزائري «دراسة مقارنة» Algerian Administrative Judicial System"a Comparative Study"

الملخص
عرفت الجزائر النظام القضائي الإداري طيلة عهد الاحتلال الفرنسي، مع التمييز الذي مارسته الإدارة الاستعمارية ضد الأهالي الجزائريين، وحرمانهم من حقوقهم وحرياتهم الأساسية. وعند الاستقلال اعتمدت الجزائر على النظام القضائي الأحادي، كنتيجة لثورة التحرير التي قلبت الوضع الذي كان سائدا مدة الاحتلال، مع الإبقاء على غرف إدارية على مستوى المجالس القضائية و المحكمة العليا، تختص بالنظر في القضايا الإدارية، وتطبق قانون الإجراءات المدنية في الإجراءات، والقانون الإداري في الموضوع. وبعد دستور 28 نوفمبر 1996، رجعت الجزائر مرة أخرى إلى نظام القضاء الإداري، بإنشاء مجلس الدولة والمحاكم الإدارية، إلا أن هذا النظام جاء منقوصا من عدة جهات، ولهذا قمنا بهذه الدراسة، طبعا ليس لتحليل هذا النظام لأن المقام لا يتسع لذلك، ولكن لإجلاء أهم هذه النقائص وإعطاء حلول عملية لها. ABSTRUCT : Algeria knew the administrative judicial system during the era of the French occupation, with discrimination practiced by the colonial administration against the Algerian people, and denying them their basic rights and freedoms. Algeria adopted at independence on the unified judicial system, as a result of the Revolution of Liberation which turned the situation that prevailed during the occupation, and retaining the administrative divisions on the level of the judicial courts and also the Supreme Court, which are competent into administrative cases, and apply Code of Civil Procedure in the proceedings, and administrative law in the object. According to the Constitution of November 28, 1996, Algeria returned again to the administrative court system through the establishment of the State court and administrative tribunals, but this system was impaired in several quarters. This research deals with the most important shortcomings included in this system and to give practical solutions.
