دور التشريع في حماية الموارد المائية الوطنية في ظل المتغيرات المناخية

الملخص
تعتبر الحماية التشريعية للموارد المائية وسيلة قانونية فعالة تستعملها الدولة للحفاظ على هذه الثروة الحيوية من كل ما قد يسيء استخدامها أو يهددها بخطر قد يؤدي إلى زوالها أو تلويثها، وذلك من خلال استحداث أساليب حمائية وقائية وعلاجية للحفاظ على البيئة المائية، الأمر الذي قد يساعد في تطبيق السياسة الوطنية في مجال حماية الموارد المائية، وكذا تحقيق التنمية المستدامة لهذه الثروة النفيسة، وهذا ما تم تجسيده من خلال تبني نظام قانوني فعال، تظهر ملامحه من خلال ذاتية القوانين الحمائية للبيئة التي تهدف إلى تحديد إجراءات المتابعة القضائية لمرتكبي الجرائم الماسة بالموارد المائية حسب طبيعة هؤلاء الأشخاص، وذلك من أجل توقيع الجزاء على كل من يمس بالثروة المائية. ولقد تضمنت هذه المداخلة مختلف الجهود القانونية التي بذلها المشرع الجزائري في سبيل حماية الأوساط المائية، والمحافظة عليها للأجيال القادمة، إلا أن هذه الجهود تحتاج إلى أرادة سياسية قوية، بالإضافة إلى تظافر الجهود في سبيل الحد من كل الأفعال والسلوكات التي تضر أو تهدد بخطر هذه الثروة الحيوية النفيسة. Abstract: Legislative protection of water resources is considered an effective legal means used by the state to preserve this vital wealth from everything that may misuse it or threaten it with a danger that may lead to its disappearance or pollution, through the development of protective, preventive and remedial methods to preserve the aquatic environment, which may help in implementing The national policy in the field of protecting water resources, as well as achieving sustainable development of this precious wealth, and this has been embodied through the adoption of an effective legal system, the features of which appear through the nature of the environmental protection laws that aim to determine the procedures for judicial follow-up of the perpetrators of crimes affecting water resources according to the nature of those people. People, in order to impose a penalty on anyone who harms water resources. This intervention included the various legal efforts made by the Algerian legislator to protect the aquatic environment and preserve it for future generations. However, these efforts require a strong political will, in addition to concerted efforts to limit all actions and behaviors that harm or threaten the danger of this wealth. Precious vitality.
