The Scientific Competence In Marriage Between Sharia And Law

Abstract
The subject of academic competence in marriage is of utmost importance in life and family organization. It is the right of a woman and her guardian that her husband is competent for her, not inferior to her in status, as he will be the head of the household, responsible for her care. As societal norms evolve with time and place, academic achievement, cultural refinement, and intellectual advancement have become crucial qualities of competence when discussing marital compatibility in our present time, especially if the woman holds high academic degrees and prestigious positions. The scientific competence in marriage is a topic that has not received much attention, focus, or research from jurists of Sharia and Arab legislators compared to other qualities considered in marital competence. ملخص يُعد موضوع الكفاءة في التحصيل العلمي في الزواج من المسائل التي تكتسي أهمية بالغة في الحياة و تنظيم الأسرة ، فمن حق المرأة وولي أمرها، بأن يكون زوجها كِفئاً لها، وأن لا يكون أدنى منها وأقل مكانة، لأنه سيصبح قوّاماً عليها، وستكون هي تحت رعايته ومسئوليته،و لما كانت أعراف الناس تتغير تبعا للظروف الزمانية و المكانية أصبح التحصيل العلمي والثقافي و الرقي الفكري بين الزوجين، من أهم صفات الكفاءة التي تلزم عند الحديث عن الكفاءة بين الزوجين في وقتنا الحاضر، خاصة إذا كانت المرأة من أصحاب الشهادات العلمية العالية و الرتب الراقية. ان الكفاءة العلمية في الزواج من المواضيع التي التي لم تحظى بالاهتمام و التركيز و البحث من فقهاء الشريعة و المشرعين العرب قدر اهتمامهم بالصفات الأخرى المعتبرة في الكفاءة في الزوج.
