حق الطفل في الحضانة والكفالة Child's Right To Hadana And Kafala

الملخص
تمثل رعاية الطفولة ضرورة اجتماعية ملحة بغرض تربية الإنسان القادر على المساهمة الإيجابية، في تنمية المجتمع والنهوض به، فمن أبرز النتائج المترتبة عن الطلاق مسألة حضانة الأطفال الناتجين عن هذا الزواج، والمشاكل التي تطرحها حول مصير الأطفال، باعتبارهم همزة الوصل الوحيدة المتبقية بين الأب والأم وذويهم بعد الطلاق. فالحضانة أجل مظاهر الرعاية التي أولتها الشريعة بالطفل، مما أثر ذلك إيجابا على التشريعات الوضعية، وتطور الأمر إلى إبرام اتفاقيات دولية من أجل ذلك، هذا إضافة لمرحلة ضم الطفل لمن لهم ولاية على النفس وهو ما يسميه الفقهاء بالكفالة، والمشرع لم يذكر هذا الحق مستقلا، واكتفى بعقد كفالة الطفل كبديل لنظام التبني. يكمن الإشكال الرئيسي: في ماذا تتمثل الحماية القانونية المقررة لحق الطفل في الحضانة والكفالة؟ وهل هذه الحماية تشكل ضمانا كافيا لنمو جيل سليم متمتع بكافة الحقوق؟ سنجيب على هذا الإشكال بالاستناد على المنهج التحليلي لنصوص المواد القانونية التي اعتـنت بهـذا الحق، دون أن نحيــد عن الغــوص في ثنـايا الفقه الإسلامي، معتمدين على مبحثين؛ الأول: حق الطفل في الحضانة ؛ والثاني: حق الطفل في الكفالة. Abstract: Childhood Care represents a pressing social need for the purpose of breeding a person is able to contribute to the development of society and the advancement of it, where it is the most prominent consequences of divorce the issue of Hadana of the children resulting from this marriage, and the problems posed by about the fate of the children. Hadana is the most important aspects of care accorded by Sharia to children, which impact positively on the positive laws, in addition to the conclusion of international conventions in this regard. In addition, there is the issue of annexation of the child for those who have jurisdiction over the self, which is called by the jurists Kafala, which is an alternative to the system of adoption. The main problematic is: What is the legal protection prescribed child's right to Hadana and Kafala ? Is this protection constitute a sufficient guarantee for the establishment of properly generation enjoys all the rights?
