أفاق الإستثمار في الجزائر في ظل تطبيق قانون الإستثمار الجديد

الملخص
ندرس في هذا المقال دور قانون الإستثمار الجديد، في جلب واستقطاب وتنظيم الإستثمارات المحلية والأجنبية بهدف الدفع بالتنمية الإقتصادية في الجزائر بصفتها المضيفة لرأس المال الأجنبي، عن طريق تحديد حقوق المستثمرين وإلتزاماتهم، والأنظمة التحفيزية المطبقة على إستثماراتهم، حيث إعتمدنا في هذه الدراسة على المنهج التحليلي، من خلال استقراء وتحليل أحكام هذا القانون ومجموع نصوصه التطبيقية، بالإضافة إلى النتائج المتوصل إليها في الفترة الممتدة من 1/11/2022 إلى 31/10/2023. من أهم نتائج المتوصل إليها هي أن القانون الجديد وصف المستثمر الأجنبي بالمستثمر غير المقيم، حتى يتساوى في تعريفه مع المستثمر الجزائري، وهو ما يؤدي إلى زيادة مستوى الوعي بالشراكات الجزائرية الأجنبية وجعلها مبنية على التوازن من جهة وتقديم القيمة المضافة من جهة أخرى، عن طريق إعطاء الأولوية لدعم المؤسسات الناشئة والمؤسسات الصغيرة والمتوسطة لتكون مستقبلا قاطرة التحول الإقتصادي في الجزائر، ودور الوكالة الجزائرية لترقية الإستثمار في تسريع وتفعيل الإستثمار،، وتجاوز مشكل بيروقراطية الإدارة بإنشاء شباك وحيد مركزي تجمع فيه جميع المصالح الإدارية ذات العلاقة بالإستثمار مخصص فقط لمرافقة وتسهيل الإستثمارات الأجنبية، ومجموعة من الشبابيك الوحيدة المحلية اللامركزية على المستويات المحلية. This article examines the role of Act No. 22-18 of 24 July 2022 on investment in attracting, attracting and regulating domestic and foreign investments in order to advance Algeria's economic development as host of foreign capital, By defining investors' rights and obligations, and the incentive regulations applicable to their investments, In this study, we relied on the analytical curriculum, through the extrapolation and analysis of the provisions of this law and its applied texts, in addition to the results reached from 1/11/2022 to 31/10/2023. One of the most important findings is that the new law replaced the term "foreign investor" with the term "non-resident investor". in order to equalize its definition with the Algerian investor, which would increase the level of awareness of Algerian foreign partnerships and make them based on balance and value added. by prioritizing support for emerging and small and medium-sized enterprises to become Algeria's future locomotive for economic transformation, The role of the Algerian Investment Promotion Agency in accelerating and operationalizing investment and overcoming the problem of the Department's bureaucracy by creating a single central network in which all administrative interests related to investment are dedicated only to escorting and facilitating foreign investments, and a set of local, decentralized single windows at local levels.
