دلالة السّياق عند الإمام الزركشي عبر كتابه البحر المحيط

الملخص

يهدف هذا البحث إلى بيان دلالة السياق من الناحية اللغوية والاصطلاحية عند الإمام الزركشي من خلال كتابه البحر المحيط في أصول الفقه، وأنه أول من أرسى دعائم هذه الدلالة إذ أنه أفرد في كتابه هذا أبوابا خاصة لمسائل تتعلق بها. فهذا الكتاب يعتبر أنموذجا تتجلى فيه حيثيات هذا الموضوع تنظيرا وتأصيلا دون غيره من المؤلفات المتقدمة في مجاله .وقد قسمت البحث إلى مقدمة ومطلبين : المقدمة ذكرت فيها الإشكالية والأهمية والدّراسات السّابقة، مع بيان منهجية البحث، أما المطلب الأول :فذكرت فيه تعريفا للزركشي وكتابه البحر المحيط، والمطلب الثاني في بيان ماهية دلالة السياق عند الزركشي، والمسائل التي ذكرها والمتعلقة بهذه الدلالة، وأخيرا خلصت إلى جملة من النتائج أهمها :أن الزركشي يعتبر أول من توسع في ذكر وتحليل مسائل هذا الموضوع، وأنه يتخذ السياق حجة في تخصيص العام وأن هناك فرقا بين التخصيص بالسّياق والتخصيص بالسبب. Abstract: The purpose of this research is to demonstrate the Significance of Context linguistically and terminologically by Al Imam Al zarkashi through his book Al-bahr Al muhit fi Usul Al fiqh, in his book he singled out a special section to demonstrate and highlight the issues concerning the significance of context, as a result he was the first to lay foundations of this Significance. Unlike all his predecessors, this book is considered as a model in which the reasoning of this significance is theoretical and inherent, which is different than from other advanced books in his domain. I parted my research into an introduction and two different sections: in the introduction, I stated, the importance and the previous studies, by presenting the methodology of this research, whereas the first section, I introduced Al zarkashi and his book Al-bahr Al muhit , however the second section, determinates the concept of the significance of the context by Alzarkashi, adding to that the subjects he stated in relation to the significance. In conclusion, I came out with a sum of results, the most important one is: Alzarkashi is considered az the first scientist who expanded his studies and issues analysis of this subject, he is considering the context as an argument in proving the specialization of what is considered common and showing the difference between the specialization as per the context and the specialization as per the reason.
